The CMF witch is not really that different than the witch's that came before so I'd say this new witch isn't so much a copy of th CMF it's just continuing their witch style motif.

I doubt LEGO would have any issues replacing missing pieces from a sealed set, regardless if has gone thru a BL reseller or not.
