But also Mikal's designs are 'art', since two of the three capes being sold were never even close to an official LEGO Product.
And those cape designs were based off of the designs I created by hand, not as simple scans but pixel by pixel hand drawing. The difference there is that I did not take an official LEGO product and pass it off as my own, but rather drew a representation of said LEGO product. I own my art, though it would probably still be illegal to sell it as-is (but in cape form, not resembling a LEGO product it probably is ok).
